1. The agreement

This site is operated by SMOVF FRAGRANCE SDN. BHD. (202501015015 (1616430-K)), of No. 15, Jalan 4/91A, Taman Shamelin Perkasa, 56100 Kuala Lumpur. Placing an order, sending an enquiry or using the site means you accept these terms and our Privacy Policy.

2. Ordering

Adding items to your cart and submitting the checkout form is an offer to buy, not a completed sale. The contract forms when we confirm your order — by email, by WhatsApp, or by marking it confirmed on your order page.

We may decline an order. The reasons are narrow and we will always tell you which one applies: the item sold out between your order and our confirmation, the price or description was wrong, payment could not be verified, we cannot deliver to your address, or we have reason to think the order is fraudulent. If we decline after you have paid, we refund you in full.

3. Prices and payment

Prices are in Malaysian Ringgit and include any tax that applies. Delivery is added at checkout and shown before you pay. The price that binds us both is the one displayed on your order confirmation.

We accept:

• Online payment — FPX online banking and cards, through a licensed Malaysian payment gateway. We are told only whether the payment succeeded; your card and banking credentials never touch this site.
• Bank transfer or DuitNow QR — you transfer from your own banking app and send us the reference. Your order is held but not dispatched until the transfer clears; if it has not cleared within 3 working days we may release the stock.
• WhatsApp order — we confirm the items and total with you in the chat and arrange payment there.

If a price is obviously wrong — a decimal point in the wrong place, a bottle listed for a fraction of its cost — we may correct it and offer you the order at the right price or a full refund. We will not quietly charge you the higher amount.

4. Stock and availability

Stock is counted per size, and the count is checked again at the moment your order is placed rather than only when you added the item to your cart. This is why an item can be in your cart and still be refused at checkout: someone else completed their order first. In that case nothing is charged.

Fragrance is made in batches. Colour and the exact opening of a scent can vary slightly between batches without the product being faulty — natural materials are not identical from harvest to harvest.

5. Delivery

Delivery charges, timing, collection and international orders are set out in Shipping & Returns, which forms part of these terms.

Risk in the goods passes to you on delivery to the address you gave us, or on collection. Please check the address before you submit the order: we cannot recover a parcel delivered correctly to the wrong address.

6. Gift codes and referrals

• A gift code may be used once, by one customer, on one order.
• Codes have an expiry date, shown when the code is issued. An expired code cannot be reinstated.
• Codes have no cash value, cannot be exchanged for cash, and cannot be combined with another code on the same order.
• If an order paid for with a code is cancelled or refunded, the code is released back to you unless it had already expired.
• Referral credit is earned when the person you referred completes a paid order. Referring yourself, or creating accounts to generate credit, voids the codes involved.

7. Signature scent, OEM and corporate work

Bespoke and private-label work is quoted individually and confirmed in a separate written proposal. That proposal governs where it differs from these terms. In general:

• A deposit is payable before formulation begins, and it covers perfumer time. It is not refundable once work has started.
• Development includes an agreed number of revision rounds. Further rounds are quoted separately.
• Minimum order quantities apply to production runs and are stated in the proposal.
• A bespoke formulation made for you is not a stock item. It cannot be returned because it is no longer wanted.
• Unless the proposal says otherwise, we retain the formulation and you receive the exclusive right to sell it under your brand for the term agreed.

8. Workshops

A workshop place is confirmed when it is paid for. Places may be rescheduled or transferred to someone else up to 7 days before the session; inside 7 days the fee is not refundable, because the materials for your bench have already been prepared. If we cancel a session, you choose between another date and a full refund.

Tell us before the session if you are pregnant or have a fragrance allergy or asthma, so we can adjust what is on your bench.

9. Using this site

You agree not to:

• place orders you do not intend to pay for;
• attempt to gain access to the admin panel, another customer's order, or any part of the site not made public;
• scrape, republish or resell our product descriptions, photography or written content;
• interfere with the site's operation, or use it to distribute anything harmful.

10. Intellectual property

The SMOVF name and logo, the fragrance names, the photography, the site design and the written content are owned by SMOVF FRAGRANCE SDN. BHD.. Buying a product does not transfer any of it. You are welcome to share a link to a product page; you may not copy the page.

11. Liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that Malaysian law does not permit us to limit.

Subject to that, our liability for any order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss — lost profit, lost opportunity, or the cost of an event you were buying the fragrance for.

Fragrance is for external use. Patch-test before wearing a new scent if you have sensitive skin, keep it away from eyes and out of reach of children, and stop using it if a reaction develops. Ingredient and allergen information is on the carton and available on request.

12. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have jurisdiction. If any clause turns out to be unenforceable, the rest continues to apply.
